  1. ACCEPTANCE OF TERMS

These Terms of Use (“Terms”) are a binding agreement between you and [INSERT LEGAL NAME OR COMPANY NAME] (“Publisher”, “we”, “us”) governing your use of the “Incredible Indian Trivia” channel for Roku devices (the “Channel”) and the website incredibleindiantrivia.approku.com (the “Site”). By installing, accessing, or using the Channel or Site you agree to these Terms and our Privacy Policy (https://incredibleindiantrivia.approku.com/privacy-policy/). If you do not agree, do not use them. If you use the Channel on behalf of others (for example in a household, classroom, or at a party), you are responsible for ensuring they follow these Terms.

You must be old enough to form a binding contract in your jurisdiction or use the Channel with the permission of a parent or guardian. Purchases require a Roku account and are subject to Roku’s terms.

  1. LICENSE

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Channel on Roku devices you own or control, for private, non-commercial entertainment. You may use it in family, social, and educational settings, but may not charge admission for or otherwise commercialize public performances without our written permission.

  1. RESTRICTIONS

You agree not to: (a) copy, modify, translate, or create derivative works of the Channel or its content, except as allowed by law; (b) reverse engineer, decompile, or attempt to extract source code, except where law prohibits this restriction; (c) extract, scrape, redistribute, or republish the questions, answers, facts, images, audio, or other content; (d) circumvent or tamper with ads, purchase verification, or entitlement checks; (e) use the Channel unlawfully, to harass others, or in a way that disrupts it; (f) use bots, exploits, or cheating tools; (g) remove proprietary notices.

  1. OWNERSHIP

The Channel, including its software, questions, answers, “Did You Know” facts, text, graphics, audio, and design, is owned by the Publisher or its licensors and is protected by copyright, trademark, and other laws. No rights are granted except as expressly stated. Feedback you send us may be used without obligation to you.

Third-party names and marks (for example Roku, Roku Pay) belong to their owners. The Channel is an independent product. It is not affiliated with, endorsed by, or sponsored by the Government of India, the Ministry of Tourism, any “Incredible India” tourism campaign, or Roku, Inc.

  1. PREMIUM PURCHASE

a) Premium is an optional, one-time, non-consumable in-channel purchase made through Roku Pay. It is not a subscription and does not renew.
b) Premium currently unlocks additional trivia categories and removes advertisements from the Channel. We may describe or adjust what the free and Premium versions include; however, we will not remove features you have already purchased without reasonable notice or remedy, except where required by law, platform rules, or to stop abuse.
c) Prices are shown in the Channel in your local currency and may vary by region or change over time. Taxes may apply. Payment, billing, receipts, and refunds are managed by Roku under Roku’s terms. We cannot issue refunds directly; please contact Roku. Nothing here limits any mandatory consumer rights (such as statutory withdrawal rights) that apply to you.
d) Premium is tied to your Roku account. Use “Restore Purchase” in the Channel if you reinstall the Channel or change devices.
e) If a purchase is reversed, refunded, or charged back, Premium may be removed.

  1. ADVERTISING

The free version may show an advertisement once at the end of a game, delivered through the Roku Advertising Framework. We do not control the content of third-party ads and are not responsible for them or for products or services they promote. Any dealings with advertisers are solely between you and them.

  1. TRIVIA CONTENT DISCLAIMER

Trivia content is provided for entertainment and general interest only. While we aim for accuracy, questions, answers, and facts (some of which may be created or assisted by automated tools) may contain errors, omissions, disputed claims, or be out of date, and some topics (history, culture, geography, religion, politics, sports, science) may be subject to differing views or naming conventions. Do not rely on the content for academic, professional, legal, medical, travel, safety, or other important decisions. We do not intend to disparage any person, community, religion, region, or nation. If you find an error or offensive content, please tell us at support@incredibleindiantrivia.approku.com.

  1. SAFETY AND HEALTH

Gameplay may involve flashing images, sound, and extended screen time. Take regular breaks, and stop playing if you feel unwell. The Channel’s “Still watching?” prompt exists to help avoid unattended long sessions. Adjust volume responsibly. Parents are responsible for supervising children’s use.

  1. AVAILABILITY AND CHANGES

We may update, suspend, or discontinue the Channel or any feature at any time, with or without notice. The Channel depends on Roku’s platform and your internet connection (for purchases and ads); we are not responsible for outages, device issues, or Roku policy changes. We may modify these Terms; the “Last updated” date will change and the current version will be posted at https://incredibleindiantrivia.approku.com/terms-of-use/ . Continued use after changes means acceptance. If you do not agree to changes, stop using the Channel.

  1. TERMINATION

We may suspend or terminate your license if you breach these Terms. You may stop at any time by removing the Channel. Sections that by nature should survive (ownership, disclaimers, limitation of liability, indemnity, governing law) survive termination.

  1. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CHANNEL AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. We do not warrant that the content is accurate or complete or that the Channel will be compatible with every device. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

  1. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLISHER AND ITS AFFILIATES, OWNERS, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO THE CHANNEL OR SITE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE CHANNEL IN THE 12 MONTHS BEFORE THE CLAIM, AND (B) US $10. Nothing in these Terms excludes liability that cannot be excluded by law (such as for death or personal injury caused by negligence, or fraud).

  1. INDEMNITY

To the extent permitted by law, you agree to indemnify and hold harmless the Publisher from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Channel.

  1. USER-ENTERED TEXT

Party Mode lets you type player or team names. These stay on your device and are shown on your screen. You are responsible for what you enter and agree not to enter unlawful, hateful, or infringing text, or others’ private information.

  1. INTELLECTUAL PROPERTY COMPLAINTS

If you believe content in the Channel infringes your rights, email support@incredibleindiantrivia.approku.com with your contact information, a description of the work, the location of the content, and a statement of good-faith belief and accuracy. We will review and act as appropriate.

  1. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of [INSERT STATE/COUNTRY], without regard to conflict-of-law rules. Subject to any mandatory consumer rights in your country of residence, the courts located in [INSERT CITY, STATE/COUNTRY] have exclusive jurisdiction, and you consent to that venue. You acknowledge that these Terms are between you and the Publisher, not Roku. Roku has no obligation to provide support or maintenance for the Channel, is not responsible for claims relating to it, and is not liable for it, except as set out in Roku’s own terms. Your use must also comply with Roku’s terms of service and policies.

  1. GENERAL

These Terms and the Privacy Policy are the entire agreement between you and us on this subject. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them. Headings are for convenience only.
